Official Rules

NO PURCHASE NECESSARY. A PURCHASE WILL NOT INCREASE YOUR CHANCES OF WINNING.

The Omni Hotels “The Local Scoop” Sweepstakes (“Sweepstakes”) starts at 12:00:01 a.m. Eastern Daylight Time (“EDT”) on May 5, 2008 and ends at 11:59:59 p.m. EDT on Sunday, August 31, 2008 (“Sweepstakes Period”). The Sweepstakes is sponsored by Omni Hotels, 420 Decker Drive, Irving TX 75062 ("Sponsor"), who is solely responsible for all aspects of this Sweepstakes. 

*The “Live Like a Local” Sweepstakes name has been replaced with “The Local Scoop” Sweepstakes name. Rules remain the same.

ELIGIBILITY: Sweepstakes is open only to individuals who are 18 years of age or older as of “Sweepstakes Start Date”, and are legal U.S, and District of Columbia residents, located in the U.S. (including Hawaii), or legal Canadian residents (except in the province of Quebec, where it is void, and wherever else prohibited or restricted by law). Void in Puerto Rico and where prohibited, taxed, or otherwise restricted by law. Employees (and members of their household or immediate family, i.e., parents, children, spouse, or siblings) of Sponsor; its respective subsidiaries, distributors, sales representatives, affiliates; advertising and promotion agencies and/or their affiliates, assigns or representatives; or any other individuals or entities involved in the development or administration of, or supply to, this Promotion, are not eligible to participate. Acceptance of prize constitutes winner and winner’s travel companion’s permission to publish the information submitted, and his/her likeness or name for advertising or promotion purposes without additional approval or compensation.

TWO WAYS TO ENTER: 1.) Go to http://livelikealocal.omnihotels.com during Sweepstakes Period, and follow the instructions for completing the online entry form and submitting your written comments (“Comments”) that describes, “local experiences, regional favorites and recommendations near the Omni Hotel where the entrant lives.” All online entries must be received by 11:59:59 p.m. EDT on August 31, 2008.

 2.) Enter by hand printing on a 3”x 5” card, your name, date of birth, address (including zip code), day & evening phone numbers, and e-mail address. Mail the card to: Omni Hotels “The Local Scoop” Sweepstakes, 90 Rockwood Place, Rochester, NY 14610.    All entries must be postmarked by August 31, 2008, and received by September 5, 2008. Maximum of Five (5) entries allowed, regardless of method of entry. Sponsor reserves the right to disqualify any person that submits more than maximum allowed entries. Sponsor is not responsible for lost, late, incomplete, invalid, unintelligible, illegible, stolen, damaged, misdirected or postage due mail and/or entries and such mail/entries will be disqualified. All entries become the exclusive property of Sponsor and will not be acknowledged or returned.

INTERNET LIMITATIONS OF LIABILITY: If for any reason this Sweepstakes is not capable of running as planned due to infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond the control of the Sponsor which corrupt or affect the administration, security, fairness, integrity or proper conduct of this Sweepstakes, the Sponsor reserves the right at its sole discretion, to disqualify any individual who tampers with the entry process, and to cancel, terminate, modify or suspend the Sweepstakes in whole or in part, at any time, without notice and award the prizes using all non-suspect eligible entries received as of this termination date. Sponsor assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or alteration of, entries. The Sponsor is not responsible for any problems or technical malfunction of any telephone network or telephone lines, computer on-line systems, servers, or providers, computer equipment, software, failure of any e-mail or entry to be received by Sponsor on account of technical problems, human error or traffic congestion on the Internet or at any Website, or any combination thereof, including any injury or damage to participant's or any other person's computer relating to or resulting from participation in this Sweepstakes or downloading any materials in this Sweepstakes. CAUTION: ANY ATTEMPT TO DELIBERATELY DAMAGE ANY WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE SWEEPSTAKES IS A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, THE SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES OR OTHER REMEDIES FROM ANY SUCH PERSON (S) RESPONSIBLE FOR THE ATTEMPT TO THE FULLEST EXTENT PERMITTED BY LAW. In the event of a dispute as to the identity of a winner based on an e-mail address, the winning entry will be declared made by the authorized account holder of the e-mail address submitted at time of entry. "Authorized account holder" is defined as the natural person who is assigned to an e-mail address by an Internet access provider, on-line service provider or other organization (e.g., business, educational, institution, etc.) that is responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address.

PRIZES: Nine (9) Grand Prizes winners will receive an Omni Hotel weekend package gift certificate for two (2) people. The Prize includes hotel accommodations (one room/double occupancy) for 3days/2nights at any U.S. Omni Hotel. Prize must be used by August 31, 2009. Approximate Retail Value (ARV) of gift certificate is $500. No prize substitution or cash equivalent of prize, except at Sponsor’s sole discretion and then only for a prize of equal of greater value. Any difference between the actual value of the prize and the ARV set forth in these Official Rules may not be claimed and will not be awarded. Blackout dates may apply.

DRAWING & NOTIFICATION: Nine (9) Grand Prize Winners will be selected, from among all eligible entries received, in a random drawing conducted on or about September 15, 2008 by Alliance Sweepstakes Services, (the “Sweepstakes Administrator”), an independent judging organization, whose decisions are final in all matters relating to this Sweepstakes. Odds of winning will depend on the total number of eligible entries received. The potential winner will be notified by phone and mail. Upon initial notification and verification of potential Grand Prize winner, confirmation will be sent to winner in writing via USPS mail, or other home delivery service of Sponsor’s choice. Winner will be featured on Sponsor’s Website.

RIGHTS TO COMMENTS & COMMENTS REQUIREMENTS: By submitting an entry, entrant warrants that the Comments (1) do not infringe any copyright, (2) does not invade anyone’s privacy, (3) does not libel or slander anyone and (4) is original and has not previously been published. An original is the product of one's own mind and is not a copy or imitation.
By submitting a Comment, entrant irrevocably assigns, conveys and otherwise transfers to Sponsor, its successors, and assigns any and all right, title, and interest in perpetuity throughout the world in and to the submitted Comment, including, without limitation, any and all copyrights, trademarks, contract and licensing rights, moral rights or “droit moral,” and other intellectual property and proprietary rights in the Comments, and the exclusive right to edit, change, revise, reproduce, display, perform, publish, distribute, license, sublicense, and sell the Comment in whole or in part, and to prepare, use, and exploit derivative works or improvements thereof, in all forms and media now or hereafter known, including material in digital and electronic media, computer, audio and audiovisual versions, and translations and adaptations, all in any language throughout the world and in Sponsor’s sole discretion in perpetuity. Without limiting the foregoing, entrant hereby waives and releases Sponsor, from any and all claims that entrant may now or hereafter have in any jurisdiction based on such “moral rights” or “droit moral” or unfair competition with respect to Sponsor’s exploitation of the Comment without further compensation to Entrant of any kind. Entrant agrees not to instigate, support, maintain, or authorize any action, claim, or lawsuit against Sponsor or its affiliates, or any other person, on the grounds that any use of the Comment, or any derivative works, infringe or violate any of entrant’s rights therein. Entrant grants the Sponsor and its agents the right to associate the Comment with entrant’s name, image, likeness, hometown, and biographical information, without limitation and without compensation. Entrants shall not receive any compensation or credit for Sponsor’s use of entries, other than that disclosed in these Official Rules.

PRIZE CONDITIONS: Winners are solely responsible for all applicable federal, state, and local taxes associated with the receipt of any prize. Each Grand Prize winner will be required to sign an Affidavit of Eligibility and Liability/Publicity Release, and return it within 14 days of written notification. Failure to comply with these Official Rules may result in disqualification from the Sweepstakes. All taxes, if applicable, are the sole responsibility of the winner. Each winner’s entry and acceptance of the prize offered constitutes permission (except where prohibited) for the Sponsor to use said winner’s name, photograph, likeness, statements, biographical information, voice and address (city and state), in all forms of media, in perpetuity, without notice or further compensation. Entrants agree to be bound by these Official Rules and by the decisions of the Sweepstakes Administrator, which are final and binding in all respects.

TERMS AND CONDITIONS: This Sweepstakes is subject to all applicable federal, state, and local laws. By participating, entrants agree to be bound by these Official Rules and the decisions of the Sweepstakes Administrator, and waive any right to claim ambiguity in the Sweepstakes or these Official Rules. Winners and entrants also agree to release, discharge, indemnify and hold harmless the Sponsor, vendors associated with the Sweepstakes, and the respective officers and employees of these entries, from and against any claims, damages or liability due to any injuries, damages or losses to any person (including death) or property of any kind resulting in whole or in any part, directly or indirectly, from acceptance, possession, use or misuse of any prize offered, or participation in this Sweepstakes. Any person attempting to defraud or in any way tamper with the Sweepstakes mechanics and/or implementation will be prosecuted to the full extent of the law. This Sweepstakes is void where prohibited.
