Official Rules
NO PURCHASE NECESSARY TO ENTER OR WIN. A PURCHASE OR PAYMENT OF ANY KIND WILL NOT INCREASE YOUR CHANCES OF WINNING.
The Omni Hotels “Select Departure” Sweepstakes (“Sweepstakes”) starts at 12:00:01 a.m. Eastern Daylight Time (“EDT”) on Monday, April 27, 2009 and ends at 11:59:59 p.m. EDT on Tuesday, September 1, 2009 (“Sweepstakes Period”). The Sweepstakes is sponsored by Omni Hotels, 420 Decker Drive, Irving, TX, 75062, (the "Sponsor").
Compliance Sweepstakes Services LLC, (the “Administrator”) 106 Elm Street, Stonington, CT 06378.
I. ELIGIBILITY:
Sweepstakes is open only to individuals who are 18 years of age or older as of
“Sweepstakes Start Date”, and are legal U.S, and District of Columbia residents, located in the U.S. (including Hawaii); or legal Canadian residents (except in the province of Quebec, where it is void, and wherever else prohibited or restricted by Canada law). Void in Puerto Rico and where prohibited, taxed, or otherwise restricted by U.S. law. Any individuals (including but not limited to employees, consultants, independent contractors, agents and interns) who have, within the past six (6) months, performed services for Omni Hotels International; Administrator; any organizations responsible for sponsoring, fulfilling, administering, advertising or promoting the Sweepstakes or supplying the prizes, and/or their respective parent, subsidiary, affiliated and successor companies, and immediate family and household members of such individuals, are not eligible to enter the Sweepstakes. "Immediate family members" shall mean parents, stepparents, children, stepchildren, siblings, stepsiblings, or spouses, regardless of where they live. "Household members" shall mean people who share the same residence at least three (3) months a year, whether related or not. Potential winner may be required to provide proof of legal U.S. residency upon request prior to prize award. Void where prohibited or restricted by law.
II. TWO WAYS TO ENTER:
1.)
Become a “Select Guest”: To be eligible to enter the Sweepstakes, you are required to enroll in the Omni Hotels’ “Select Guest” Program. Go to www.omnihotels.com/selectdeparture, (the “Website”) during the Sweepstakes Period, and follow the instructions for completing the online “Select Guest” enrollment. Upon completion of enrollment, you will be automatically entered into the Sweepstakes and will receive one (1) entry into the Sweepstakes.
Invite Your Friends:
You will receive up to a maximum of six (6) Entries when you invite friends to the Site. To receive Entries for inviting friends, click on the “Invite A Friend” link and enter your email address and the email address(es) of up to six (6) friends at a time. Each friend will be sent an email from the Sponsor containing a link to the Site, which may identify you as having recommended that the email be sent. You may only invite persons from whom you have received permission to provide their email address to the Sponsor, and to whom email from you or the Sponsor would not be considered an unsolicited commercial email. For each friend that you invite that: (A) has a valid email address, you will receive one (1) Entry, to a maximum of six (6) Entries during the Promotion Period; (B) visits the Site using the link contained within the email during the Sweepstakes Period, you will receive one (1) Entry, to a maximum of six (6) Entries during the Sweepstakes Period.
2.) Alternative Means of Entry:
Enter by hand printing on a 3”x 5” card, your name, date of birth, address (including zip code), day & evening phone numbers, and e-mail address. Mail each card separately to: Omni Hotels “Select Departure” Sweepstakes, 90 Rockwood Place, Rochester, NY 14610. All entries must be postmarked by August 27, 2009, and received by September 1, 2009. Maximum of seven (7) entries per address is allowed, regardless of method of entry. Sponsor reserves the right to disqualify any person that submits more than maximum allowed entries. Sponsor is not responsible for lost, late, incomplete, invalid, unintelligible, illegible, stolen, damaged, misdirected or postage due mail and/or entries and such mail/entries will be disqualified. All entries become the exclusive property of Sponsor and will not be acknowledged or returned.
III. INTERNET LIMITATIONS OF LIABILITY:
If for any reason this Sweepstakes is not capable of running as planned due to infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond the control of the Sponsor which corrupt or affect the administration, security, fairness, integrity or proper conduct of this Sweepstakes, the Sponsor reserves the right at its sole discretion, to disqualify any individual who tampers with the entry process, and to cancel, terminate, modify or suspend the Sweepstakes in whole or in part, at any time, without notice and award the prizes using all non-suspect eligible entries received as of this termination date. Sponsor assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or alteration of, entries. The Sponsor is not responsible for any problems or technical malfunction of any telephone network or telephone lines, computer on-line systems, servers, or providers, computer equipment, software, failure of any e-mail or entry to be received by Sponsor on account of technical problems, human error or traffic congestion on the Internet or at any Website, or any combination thereof, including any injury or damage to participant's or any other person's computer relating to or resulting from participation in this Sweepstakes or downloading any materials in this Sweepstakes. CAUTION: ANY ATTEMPT TO DELIBERATELY DAMAGE ANY WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE SWEEPSTAKES IS A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, THE SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES OR OTHER REMEDIES FROM ANY SUCH PERSON (S) RESPONSIBLE FOR THE ATTEMPT TO THE FULLEST EXTENT PERMITTED BY LAW. In the event of a dispute as to the identity of a winner based on an e-mail address, the winning entry will be declared made by the authorized account holder of the e-mail address submitted at time of entry. "Authorized account holder" is defined as the natural person who is assigned to an e-mail address by an Internet access provider, on-line service provider or other organization (e.g., business, educational, institution, etc.) that is responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address.
IV. PRIZE:
One (1) Grand Prize
winner will receive an Omni Hotel weeklong vacation for two (2) people to Manhattan, NY. Approximate Retail Value (“ARV”) $10,000. The Prize includes: two American Airline round trip business class tickets (“ARV”) $600; hotel accommodations in the Presidential Suite for 7 days/6 nights at the Omni Berkshire Place (“ARV”) $6,600; dinner at the hotel’s Fireside Restaurant (“ARV”) $300, plus $2,500 spending cash. Prize must be used by August 31, 2010. A cash prize substitution option of $5,000 (50% of Prize Value) is available.
V. TRIP PRIZE CONDTIONS:
All travel arrangements must be made through the Sponsor’s Travel Department. A Winner, who lives within a 200-mile radius of the designation, will not receive the air transportation portion of the prize, but a $500 travel allowance.
Prize suppliers will make every effort to confirm reservations as requested, however, t
ravel and accommodations are subject to capacity controls, availability, blackout dates and other restrictions, all of which are subject to change and may not be in Sponsor’s control.
The prize must be executed by August 31, 2010, or the prize will be forfeited. The Prize awarded consisting of products/services for two people require that the winner and their companion redeem the prize together.
It is each winner’s sole responsibility for winner and any guest to obtain and travel with the required documents
. Winner and travel companion must execute liability/publicity release and travel companion waiver prior to issuance of travel documents. If travel companion is a minor, parent or legal guardian must sign and return release, as well as accompany minor on trip. Sponsor will not replace any lost, mutilated, or stolen travel vouchers or certificates. Once travel commences, no stopovers are permitted; if stopover occurs, full fare will be charged from stopover point for the remaining segments, including return, of the trip. All local, state and federal taxes are the sole responsibility of winner. Travel restrictions, conditions and limitations may apply. The prize is subject to availability, advance reservations and other restrictions, including state, local and federal laws and limitations that may apply.
Each winner will be responsible for all ground transportation, tips, gratuities, service charges, taxes, meals not specified in prize package, hotel room service, laundry service, alcoholic beverages, merchandise, souvenirs, local and long-distance telephone calls,
site-seeing excursions
and any other incidental costs or expenses not identified in these Official Rules.
The total value of the airfare, hotel accommodations, and trip extras may not exceed $10,000. Trip may not be combined with any other offer and travel may not qualify for frequent flyer miles. Sponsor reserves the right, at its sole discretion, to substitute any prize package with another prize of equal or greater value in the event that the advertised prize (or any component thereof) is not available. All decisions by Sponsor as to prizewinner and prizes are final. All local, state and federal taxes are the sole responsibility of winner. The Prize package is not exchangeable or transferable. However, prize is redeemable for cash at fifty percent of total value of final and actual prize value. Actual retail value of the Prize depends on location of winner and fares at time of departure.
The Approximate Retail Value (“ARV”) of all prizes“ is $10,000.
VI. DRAWING & NOTIFICATION:
The Grand Prize Winner will be selected, from among all eligible entries received, in a random drawing conducted on or about September 15, 2009 by Compliance Sweepstakes Services LLC, (the “Sweepstakes Administrator”), an independent judging organization, whose decisions are final in all matters relating to this Sweepstakes. Odds of winning will depend on the total number of eligible entries received. The potential winner will be notified by phone and mail. Upon initial notification and verification of potential Grand Prize winner, confirmation will be sent to winner in writing via USPS mail, or other home delivery service of Sponsor’s choice. Winner will be featured on Sponsor’s Website.
VII. PRIZE CONDITIONS:
Winners are solely responsible for all applicable federal, state, and local taxes associated with the receipt of any prize. The Grand Prize winner will be required to sign an Affidavit of Eligibility and Liability/Publicity Release, and return it within 14 days of written notification. If a Canadian citizen wins the prize they will be required to answer, unaided, a mathematical skill-testing question. If a potential winner from Canada cannot be contacted and the skill test administered within three (3) days of notification, or the question is not correctly answered, the prize will be forfeited and an alternate winner will be selected. Failure to comply with these Official Rules may result in disqualification from the Sweepstakes. All taxes, if applicable, are the sole responsibility of the winner. Each winner’s entry and acceptance of the prize offered constitutes permission (except where prohibited) for the Sponsor to use said winner’s name, photograph, likeness, statements, biographical information, voice and address (city and state), in all forms of media, in perpetuity, without notice or further compensation. Entrants agree to be bound by these Official Rules and by the decisions of the Sweepstakes Administrator, which are final and binding in all respects.
VIII. TERMS AND CONDITIONS:
This Sweepstakes is subject to all applicable federal, state, and local laws. By participating, entrants agree to be bound by these Official Rules and the decisions of the Sweepstakes Administrator, and waive any right to claim ambiguity in the Sweepstakes or these Official Rules. Winners and entrants also agree to release, discharge, indemnify and hold harmless the Sponsor, vendors associated with the Sweepstakes, and the respective officers and employees of these entries, from and against any claims, damages or liability due to any injuries, damages or losses to any person (including death) or property of any kind resulting in whole or in any part, directly or indirectly, from acceptance, possession, use or misuse of any prize offered, or participation in this Sweepstakes. Any person attempting to defraud or in any way tamper with the Sweepstakes mechanics and/or implementation will be prosecuted to the full extent of the law. This Sweepstakes is void where prohibited.
IX. DISPUTES:
Except where prohibited, as a condition of participating in this Sweepstakes, entrant agrees that any and all disputes which cannot be resolved between the parties, claims and causes of action arising out of or connected with this Sweepstakes, or any prizes awarded, or the determination of winners shall be resolved individually, without resort to any form of class action exclusively by arbitration pursuant to the commercial arbitration rules of the American Arbitration Association, then effective. Further, in any such dispute, under no circumstances will entrant be permitted to obtain awards for, and hereby waives all rights to claim punitive, incidental or consequential damages, or any other damages, including attorneys' fees, other than entrant's actual out-of-pocket expenses (e.g., costs associated with entering this Sweepstakes), and entrant further waives all rights to have damages multiplied or increased. The arbitration shall be conducted in the State of Texas, in the City of Irving, County of Dallas, and judgment on the arbitration award may be entered into any court having jurisdiction thereof.
X. Winners List/Official Rules Request:
For the names and city/state of residence of prizewinners or a copy of these Official Rules send a self-addressed, stamped envelope postmarked by 10/8/09 and received by 10/12/09 specifying Winners List or Official Rules request to: CSS/ Select Departure Sweepstakes Winners List, 106 Elm St, Stonington, CT 06378. VT & WA residents may omit return postage.
