Official Rules
NO PURCHASE NECESSARY TO ENTER OR WIN. PARTICIPATION CONSTITUTES PARTICIPANT’S FULL AND UNCONDITIONAL AGREEMENT TO AND ACCEPTANCE OF THESE OFFICIAL RULES. NO CURRENT PRESIDENTAL CANDIDATE CAN BE MENTIONED BY NAME OR IMITATED IN VIDEO SUBMISSION. VIDEOS THAT MENTION A CANDIDATE’S NAME OR IMITATES A CANDIDATE WILL NOT BE APPROVED FOR SUBMISSION. VOID WHERE PROHIBITED.
I. VIDEO SUBMISSION PERIOD: The #Me4President Video Contest (the “Contest” or “Promotion”) begins on or about 12:00:01 p.m. Eastern Time (“ET”) on October 18, 2016 (“Start Date”) and ends at 11:59:59 p.m. ET on November 4, 2016 (the “Entry Period”). The Contest is sponsored by, Omni Hotels and Resorts, 4001 Maple Ave, Dallas, TX 75219 (the “Sponsor” and “Prize Supplier”). The official clock for purposes of the Contest is the computer of the Sponsor.
II. ELIGIBILITY: The Contest (“Contest”) is open solely to a parent or legal guardian who is eighteen (18) years of age or older, a legal resident of the fifty (50) states in the United States and the District of Columbia, and their child is fourteen (14) years of age or under, as of the Contest Start Date. To participate in the Contest, parents, family members or legal guardians must have Internet access and a valid, public Instagram account. Becoming an Instagram member is free. If you are not an Instagram member, and would like to become one, visit www.Instagram.com and follow the onscreen instructions to open an account. Officers, directors and employees of Omni Hotels Management Corporation, TRT Holdings, its subsidiary and affiliated organizations or companies, advertising, promotional and judging agencies, persons engaged in the development, production or distribution of materials for this Promotion (collectively, the “Released Entities”), and members of the immediate families (defined for these purposes as including parents, grandparents, children, grandchildren, siblings, and each of their respective spouse) or households (whether related or not) of any of the above, are NOT eligible to enter or win. The Contest is subject to all applicable federal, state, and local laws and regulations. Participation constitutes a parent, a family member (grandparent, aunt, etc.) or legal guardian who actively creates and enters a video of their child according to entry requirements as defined in Section III. The parent or legal guardian will be deemed a participant (“Participant(s)” or “you”) in these Official Rules (“Official Rules”). Sponsor and Administrator’s decisions, which are final and binding in all matters related to the Contest. Entry constitutes a Participant’s certification that he/she meets the eligibility requirements set forth in these Rules. Sponsor reserves the right to verify eligibility of any potential winner. Winning a prize is contingent upon fulfilling all requirements set forth herein. Void in Puerto Rico, the U.S. Virgin Islands, U.S. Military installations in foreign countries, and where prohibited, taxed, or restricted by law.
III. HOW TO ENTER: Participants are invited to enter the #Me4President Video (“Video”) Contest by creating a Video clip of your child pretending to be a presidential candidate and responding to at least one(1) of the following four (4) questions: 1.) Why would you make a great President?; 2.) What would you do on your first day as President?; 3.) How would you decorate the Oval Office?; 4.) If you could create a National Holiday, what would it be? Participants are encouraged to be as creative as possible, showcase your child’s personality to demonstrate why they should be chosen. Use of props or other creative treatments is highly encouraged. (Refer to Section IV for Video Guidelines and Content Restrictions)
Video Submission Entry Steps: 1.) A Participant must “Follow” the @OmniHotels Instragram account found at http://Instagram.com/omnihotels. 2.) Participant must post the Video submission (“Video Submission”) on their public Instagram account. 3.) In the comments area of the Instagram post, the Participant must include the @OmniHotels and #Me4President tag. The Submission must include all three (3) steps for the Video Submission to be valid. You may submit up to a maximum of five (5) Video Submissions. All Video Submissions must be received by 11:59:59 p.m. ET on November 4, 2016 (“Video Submission Period”) Videos received after the Video Submission Period are automatically disqualified.
IV. VIDEO GUIDELINES AND CONTENT RESTRICTIONS: The Video MUST BE no longer than 60 seconds in length. The Sponsor reserves the right to disqualify any Video Submission that in its sole judgment is greater than 60 seconds. The Video must directly address one of the four questions, as outlined in Section III. The Video must feature a child between the ages of two and fourteen years, answering one (1) of the four (4) questions in Section III. All Videos must be submitted in English and in one of the following formats: AVI, MOV, MPG, or WMV. A completed and submitted Video is final and may not be modified or edited further and becomes property of the Sponsor.
The Video, and the components thereof, must be the original work of the Participant, and must have been created in a legal and safe manner. An original is the product of one’s own mind and is not a copy or imitation. If the Video contains any material or elements that are not owned by the Participant and/or are subject to the rights of third parties, the Participant is responsible for obtaining, prior to Submission of the Video, any and all releases and consents necessary to permit the use and exhibition of the Video and all of the components thereof by Sponsor in the manner set forth in these Official Rules, including, without limitation, name and likeness releases for any person who appears in or is identifiable in the Video, and permission to reproduce, distribute, publicly display or otherwise use the Video (collectively, the “Clearances”). By submitting a Video, Participant warrants, represents and consents to the Submission and use of the Video in the Contest, and to its posting on Instagram in connection with the Contest.
Instagram Content Restrictions;
The Instagram Video Submission must not contain material that violates or infringes another’s rights, including but not limited to privacy, publicity or intellectual property rights, or that constitutes copyright infringement; must not include a current presidential candidate’s name or imitated; must not disparage Sponsor, Administrator or any other person or party affiliated with the Contest; must not contain brand names or trademarks other than those owned by Sponsor, which Participant has a limited license to use to incorporate in his/her Submission in this Contest; must not contain images or artwork not created by the Participant; must not contain material that is inappropriate, indecent, obscene, hateful, tortious, defamatory, slanderous or libelous; must not contain material that promotes bigotry, racism, hatred or harm against any group or individual or promotes discrimination based on race, gender, religion, nationality, disability, sexual orientation or age; and must not contain material that is unlawful, in violation of or contrary to the laws or regulations in any state where Submission is created.
All required information must be completed to enter and to be eligible to win. Incomplete Submissions will be disqualified. Internet entries must be made by the Participant only at the Website or aforementioned address. Entries made by any other individual or any entity, and/or originating at any other web site or e-mail address, including, but not limited to, commercial Contest subscription notification and/or entering service sites, will be declared invalid and disqualified for this Contest. Sponsor reserves the right, in its sole discretion, to void any and all entries of a Participant that submits more than the stated maximum limit of entries by using multiple / different addresses, identities, or any other methods, or who Sponsor believes has attempted to tamper with, influence or impair the administration, security, fairness, or proper play of this Contest. Proof of entering information is not considered proof of delivery to or receipt by Sponsor of an Video Submission. The use of automated entry devices is prohibited and no mechanically reproduced entries are allowed; all such entries are void. Released Entities are not responsible for: lost, late, incomplete, illegible, incorrect, damaged, delayed, garbled, undelivered, or misdirected Submissions, which will be disqualified. All Submission become the exclusive property of Sponsor and will not be acknowledged or returned. Sponsor (or its designee) will be reviewing all Video Submissions.
V. RIGHTS: Uploading a Submission constitutes a Participant’s consent to give Sponsor a royalty-free, irrevocable, perpetual, non-exclusive license to use, reproduce, modify, publish, create derivative works from, and display such submissions in whole or in part, on a worldwide basis, and to incorporate it into other works, in any form, creative, media or technology now known or later developed, including for promotional or marketing purposes. If requested, Participant will sign any documentation that may be required for Sponsor or its designees to make use of the non-exclusive rights Participant is granting to use the Video Submission. Released Entities (as defined in Section II) are not responsible for lost, late, stolen, damaged, incomplete, invalid, un-intelligible, garbled, delayed or misdirected Video Submissions; all of which will be void.
VI. CONTEST WINNER DETERMINATION: The Video Contest is a skill-based Contest, and chance plays no part in the determination of the One (1) Grand Prize Winner (“Winner”). Video Submissions will be judged by a qualified panel of judges, selected by the Sponsor in its sole discretion. Each Video Submission will be judged according to the clear relationship between the Video content and the #Me4President theme. Judging is based upon the following criteria: Appropriateness to Theme and How the Question is Answered (Score 1-10); Originality (Score 1-10); Creativity (Score 1-10); and Broad Appeal (Score 1-5). The Winner will be notified by phone on or about November 7, 2016. In the event a tie between eligible Participation Finalists, the tie may be broke by an additional Judge (“Judge”) who will resolve the tie by ranking the tied Submissions according to such Judge’s opinion on how the question was answered. The Judges’ decisions are final and binding in all matters relating to this Contest.
VII. PRIZE: One (1) Grand Prize Winner parent or legal guardian will be awarded a 2-nights and 3-days stay in any one (1) of the Omni Hotels’ Presidential Suites (the “Presidential Suite Prize” or “Prize”). Prize includes a $500 Omni Hotel Gift Card to be used at the selected Omni Hotel and Resort location. (Prize does not include airfare and ground transportation) Total ARV of Grand Prize Pool is $3,000.00.
VIII. GRAND PRIZE CONDTIONS: Grand Prize Winner is able to chose from any one of the thirty Omni Hotel’s Presidential Suites, in order to enjoy a 2-night/3-day Presidential Suite experience, with or without their children. (Link to list of approved properties/suites located on #AtTheOmni found here). Prize also includes a $500.00 Omni Hotel Gift Card to be used for Omni Hotel food and beverages, resort activities and other incidentals that may be obtained during the stay at the Omni Hotel. While the Prize Supplier will make every effort to confirm reservations as requested, operational and/or market conditions may prevent them from doing so on your requested dates. Accommodations are subject to capacity controls, availability, blackout dates and other restrictions, all of which are subject to change at Sponsor’s sole discretion. The Presidential Suite Prize is not exchangeable, transferable, or redeemable for cash. There are no substitutions unless specified by the Sponsor. Prize details and availability are subject to change, and in the event that Sponsor is unable to provide the Winner with the Prize won, the Sponsor may elect, at the Sponsor’s sole and absolute discretion, to provide Winner with the approximate value of such item in cash or award an alternate prize of comparable or greater value. The stated ARV of the Prize is based on available information provided to Sponsor at the time these Official Rules were drafted (and any difference in ARV at the time of awarding will not be awarded) and the value of the Prize awarded to a Winner will be reported for tax purposes as required by law. An unclaimed Prize will be forfeited. A properly claimed Prize will be awarded. The Sponsor and its agents are not in any way responsible or liable for damages resulting from shipping and handling, loss, use or misuse of any Prize awarded in this Contest. All decisions by Sponsor as to Winner and the Prize are final. The Presidential Suite Prize must be completed by December 31, 2017 or Prize will be forfeited. Additional Prize award details will be provided to the Winner at the time of notification. The total value of the hotel accommodations, and the Omni Gift Card cannot exceed $3,000.00 (USD).
All expenses not specifically mentioned herein, are not included as part of the Presidential Suite Prize, and are solely the Grand Prize Winner’s responsibility, including, but not limited to: ground transportation, travel insurance, room service, bag check fees, parking fees, laundry service, food, alcoholic beverages, merchandise, souvenirs, telephone calls, tips, gratuities and service charges, site-seeing excursions and any other incidental costs or expenses not identified in these Official Rules. Sponsor is not liable for, and no refund or compensation will be made in the event of a cancellation, except at the sole and absolute discretion of Sponsor. Travel companions must execute a liability/publicity waiver (“Companion Waiver”) prior to issuance of Prize documents. If a travel companion is a minor, the parent or legal guardian must sign and return the Companion Waiver and accompany the minor on the Presidential Suite Prize.
If the Winner becomes disabled or cannot otherwise fully enjoy the Presidential Suite Prize due to illness, Sponsor shall have the option of: (a) being relieved of liability for fulfillment of the prize award; or (b) at Sponsor’s sole and absolute discretion, extend the period during which the Prize may be awarded for a period equal to the duration of the Prize Winner’s disability or illness, in which case certain Prize components may not be available. The Winner must prove such disability by a doctor’s certificate, which certificate shall be endorsed by another physician agreeable to Sponsor and Winner at Sponsor’s expense.
IX. GENERAL PRIZE TERMS AND CONDITIONS: The Grand Prize Winner is required to comply with any and all applicable federal, state and local laws, rules and regulations. The stated “ARV” of the Prize is based on available information provided to Sponsor at the time these Official Rules were drafted (and any difference in ARV at the time of awarding will not be awarded) and the value of any Prize awarded to the Winner may be reported for tax purposes as required by law. The Winner will be solely responsible for all federal, state and/or local taxes, and for any other fees or costs associated with the Prize they receive. The Winner receiving a Prize valued over $600.00 will be required to sign an Affidavit of Eligibility and Liability/Publicity Release (collectively, the “Prize Acceptance Release”) and provide Sponsor with a valid social security number before the Prize can be awarded, for tax reporting purposes. An IRS Form 1099 will be issued in the name of the Grand Prize Winner. The Winner’s travel companion must sign a Travel Companion Waiver (“Travel Companion Waiver”) and return it within five (5) days of notification. Winner and Travel Companions may also be required to send a copy of their passport, driver’s license or birth certificate as proof of age. Non-compliance may result in disqualification. If any potential Winner fails or refuses to sign and return such Prize Acceptance Release within the time period required by Sponsor or if the Prize or Prize notification is returned as rejected, faulty, unclaimed or returned as undeliverable to such potential Winner, such potential Winner may be disqualified and an alternate Winner may be selected. Non-compliance shall result in disqualification and award of the Prize will be to an alternate Winner. If a potential Winner is found to be ineligible, or if he or she has not complied with these Official Rules, or if the potential Winner cannot attend or participate in any portion of the Prize, or declines the Prize for any reason prior to the award, such potential Winner may be disqualified and an alternate potential Winner may be selected. If, for any reason, more bona fide Winners come forward seeking to claim Prizes in excess of the number of each type of Prize set forth in these Official Rules, the Winner, or remaining Winners, as the case may be, of the advertised number of Prizes available may be selected in a random drawing from among all persons making purportedly valid claims for such Prize. Inclusion in such drawing shall be each Participant’s sole and exclusive remedy under such circumstances. The Release Entities are not responsible for and shall not be liable for late, lost, damaged, intercepted, misdirected, or unsuccessful efforts to notify the potential Winner. A properly claimed Prize will be awarded. The Sponsor and its agents are not in any way responsible or liable for damages resulting from shipping and handling, loss, use or misuse of any Prize awarded in this Sweepstakes.
X. LIMITATIONS OF LIABILITY: If this Contest is not capable of running as planned for any reason, including, without limitation, due to infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond the control of the Sponsor which corrupt or affect the administration, security, fairness, integrity or proper conduct of this Contest, the Sponsor reserves the right, in its sole discretion, to disqualify any individual who tampers with the entry process, and to terminate, modify or suspend the Contest, in whole or in part, at any time, without notice and award the prizes using all non-suspect eligible entries received as of or after (if applicable) this termination or suspension date. Any person who supplies false information, obtains entries by fraudulent means or is otherwise determined to be in violation of these Official Rules in an attempt to obtain any prize will forfeit any prize won and may be prosecuted to the full extent of the law. Released Entities assume no responsibility for any incomplete, incorrect, or inaccurate information, whether caused by Website users, tampering, hacking, or by any of the equipment or programming associated with or utilized in the Contest or by any technical or human error. Released Entities assume no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or alteration of, entries. The Released Entities are not responsible for any problems or technical malfunction of any telephone network or telephone lines, computer on-line systems, servers, or providers, computer equipment, software, failure of any e-mail or entry to be received by Sponsor on account of technical problems, human error or traffic congestion on the Internet or at any Website, or any combination thereof, including any injury or damage to entrant’s or any other person’s computer (or any information/material stored therein) relating to or resulting from participation in this Contest or downloading any materials in this Contest. CAUTION: ANY ATTEMPT TO DAMAGE ANY WEB SITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE CONTEST IS A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, THE SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES OR OTHER REMEDIES FROM ANY SUCH PERSON(S) RESPONSIBLE FOR THE ATTEMPT TO THE FULLEST EXTENT PERMITTED BY LAW. In the event of a dispute as to the identity of a winner based on an e-mail address, the winning entry will be declared made by the authorized account holder of the e-mail address submitted at time of entry. “Authorized account holder” is defined as the natural person who is assigned to an e-mail address by an Internet access provider, on-line service provider or other organization (e.g., business, educational, institution, etc.) that is responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address.
XI. USE OF PERSONAL INFORMATION/OPT IN: By entering via the Sponsor’s application page, you consent for the Sponsor to obtain, use, and transfer your name, address and other information for the purpose of administering this Contest; the information that you provide in connection with the entry process will be used by Sponsor only, and will not be sold or provided to another company. You are authorizing the Sponsor to send you e-mails to the address entered on entry form, regarding products and services. You may opt out of receiving future e-mails from Sponsor by clicking on the link contained in the most recent e-mail received. You will remain eligible for this Contest whether or not you opt out of receiving promotional e-mails from the Sponsor.
XII. RELEASES: All Participants, as a condition of participation in this Contest, agree to indemnify, release and hold harmless Sponsor, Instagram, and Released Entities from and against any and all liability, claims, damages, injuries or actions of any kind whatsoever for injuries, damages, or losses to persons or property which may be sustained in connection with: (a) accessing the Sponsor’s Website; (b) participating in any aspect of the Contest, including, without limitation, while preparing for, participating in and/or traveling to or from any Prize or Contest-related activity, including, without limitation, any injury, damage, death, loss or accident to person or property; (c) the receipt, ownership, possession, use or misuse of any Prize awarded; (d) viruses or any downloading or other problems with the Contest Application, or; (e) any typographical or other error in these Official Rules or the announcement of offering of any Prize. Prize Winner bears all risk of loss or damage to his/her respective Prize after it has been delivered.
XIII. GOVERNING LAW/DISPUTES: By participating in the Contest, Participants agree to be bound by the Official Rules, Sponsor’s Web Site Terms of Use (if any and if applicable to Participant’s method of participating), and the decisions of the Sponsor and Administrator, which are final and binding in all respects. Except where prohibited, Participant agrees that: (1) any and all disputes, claims and causes of action arising out of or connected with this Contest or any prize awarded shall be resolved individually, without resort to any form of class action, and any judicial proceeding shall take place in a federal or state court in State of Texas, in the City of Dallas; (2) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this Contest, but in no event legal fees; and (3) under no circumstances may Participant obtain awards for, and Participant hereby waives all rights to claim, indirect, punitive, incidental and consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of the Participants, Sponsor, or the Released Entities in connection with the Contest, shall be governed by, and construed in accordance with, the laws of the State of Texas without giving effect to any choice of law or conflict of law rules (whether of the State of Texas or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the State of Texas.
XIV. WINNERS LIST/OFFICIAL CONTEST RULES REQUEST: For the names and city/state of residence of the Grand Prize Winner, or a copy of these Official Rules, send a request specifying a copy of the Winners’ List or Official Rules along with a self-addressed, stamped envelope to be received by 12/06/16 to: Compliance/#Me4President Video Contest, PO Box 468, Stonington, CT 06378.

XVII. MISCELLANEOUS: The names of individuals, groups, companies, products and services mentioned herein, and any corresponding likenesses, logos and images thereof reproduced herein, have been used for identification purposes only and may be the copyrighted properties and trademarks of their respective owners. The mention of any individual, group or company, or the inclusion of a product or service as a prize, does not imply any association with or endorsement by such individual, group or company or the manufacturer or distributor of such product or service and, except as otherwise indicated, no association or endorsement is intended or should be inferred. The invalidity or unenforceability of any provision of these Official Rules or the Prize Acceptance Release will not affect the validity or enforceability of any other provision. In the event that any provision of the Official Rules or the Prize Acceptance Release is determined to be invalid or otherwise unenforceable or illegal, the other provisions will remain in effect and will be construed in accordance with their terms as if the invalid or illegal provision were not contained herein. Sponsor’s failure to enforce any term of these Official Rules will not constitute a waiver of that provision. For Entrant, to the extent there is a conflict between Official Rules appearing any other location and any terms of use or other agreements posted on the Sponsor’s Web Site, these are the Official Rules to be abided by.
This Contest is in no way sponsored, endorsed or administered by, or associated with Instagram. You are providing your information to Sponsor and not to Instagram. The information you provide will only be used for the purpose set forth in the Official Rules.
